| Contract. To authorise Berkshire Motor Car Company Ltd (“the Company”) to purchase a vehicle on your behalf or to purchase a vehicle from the Company a signed Purchase Order will be required from you. This will be provided to you by the Company who will not act on your behalf prior to receipt of this. By providing the signed Purchase Order to the Company you will be entering into a contract with the Company and will be bound by its terms and conditions. Payments. We offer a variety of payment options including cheque or bank transfers. A minimum 10% (ten percent) deposit will be paid with order. No reservations of vehicles can be made for you prior to receipt of your deposit. If no deposit is received from you within 48 (forty eight) hours of receipt of your signed Purchase Order (which will be supplied by the Company) your order will be cancelled. The full balance of payment is required by the Company within 5 (five) days of receipt of your deposit. If this is not received, your order will be cancelled and your deposit will be refunded to you less any bank and administrative charges not exceeding £200.00, plus a handling fee of £25.00. When purchasing through our Purchase Direct© program the full maximum agreed purchase price for the vehicle and any fees are payable in advance, to be received by the Company at least 24 (twenty four) hours in advance of the advised auction date. The Company will then bid for the vehicle on your behalf to a pre-arranged maximum purchase price. Once the funds provided by you have been used to secure the vehicle it becomes your property, unless any fees or delivery charges are outstanding, in which case (a) any outstanding fees or payments shall remain due and payable to the Company and must be paid within 5 (five) days of the date of purchase of the vehicle. If those fees have not been received within 35 days of the purchase date (b)the Company reserves the right to sell the vehicle and refund any monies earnt from the sale, less an administration and cancellation fee and any bank charges or fees and/or other fees and costs incurred, including but not limited to re-advertising and storage fees, not exceeding £1,000.00 (one thousand Great British Pounds). If the Company is not successful in obtaining your chosen vehicle your monies will be refunded to you in full or kept in the Company’s client trust account, held with Royal Bank of Scotland, pending the purchase of another vehicle on your behalf, at your request. Insurance. Valid insurance must be in place for your purchased vehicle prior to collection or delivery. Information & misrepresentation. Whilst the Company makes every effort to ensure that all information supplied is correct, it cannot be held liable or responsible for any errors or misrepresentations about the vehicles advertised or offered as all such information supplied to and used by the Company done so in good faith by the Company. Insurance. 7-day drive-away insurance is subject to approval by Norwich Union/Underwriter and your acceptance cannot be guaranteed by the Company. |
